Is Mediation Less Expensive than other approaches?

Mediation is the least expensive approach to divorce, apart from doing it yourself. How is mediation less expensive?

  1. Most mediation sessions are 2 hours. And, most divorce mediations are 2-5 sessions. By contrast, court litigation – which can include hearings, letter-writing between counsel, discovery, pre-hearing conferences, preparation of declarations, subpoenas, points and authorities, and all other aspects of litigation – can go on for weeks, months or even years.
  2. Even if you hire a consulting attorney in mediation (though often people in a mediation choose to proceed without lawyers), your lawyer’s preparation time will be much less extensive and less expensive.
  3. You typically share the cost of the mediator, which is typically much less than what one attorney would cost if you went to court.
  4. There are no deposition transcript costs, or other court expenses associated with mediation.
  5. Discovery in mediation is usually limited or not used at all, thereby keeping legal costs down.
  6. Your mediator will typically be able to give you a range for most mediations, assuming they are low to moderate in conflict.
  7. Mediation can be done over Zoom or other remote means, this cuts down on driving time for you and/or your attorney. It also allows people to participate from the comfort of their homes or offices.
